Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Autonomy has been central to moral and political philosophy for millenia, and has been positioned as a critical aspect of both justice and wellbeing. Research in psychology supports this position, providing empirical evidence that autonomy is critical to motivation, personal growth and psychological wellness. Responsible AI will require an understanding of, and ability to effectively design for, human autonomy (rather than just machine autonomy) if it is to genuinely benefit humanity. Yet the effects on human autonomy of digital experiences are (...) neither straightforward nor consistent, and are complicated by commercial interests and tensions around compulsive overuse. This multi-layered reality requires an analysis that is itself multidimensional and that takes into account human experience at various levels of resolution. We borrow from HCI and psychological research to apply a model (“METUX”) that identifies six distinct spheres of technology experience. We demonstrate the value of the model for understanding human autonomy in a technology ethics context at multiple levels by applying it to the real-world case study of an AI-enhanced video recommender system. In the process we argue for the following three claims: 1) There are autonomy-related consequences to algorithms representing the interests of third parties, and they are not impartial and rational extensions of the self, as is often perceived; 2) Designing for autonomy is an ethical imperative critical to the future design of responsible AI; and 3) Autonomy-support must be analysed from at least six spheres of experience in order to approriately capture contradictory and downstream effects. Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. Moreover, representation theorems w.r.t. constructions based on selection functions are obtained for all the operations. (shrink)

In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. In this paper two systems of AGM-like Paraconsistent Belief Revision are overviewed, both defined over Logics of Formal Inconsistency (LFIs) due to the possibility of defining a formal consistency operator within these logics. The AGM° system is strongly based on this operator and internalize the notion of formal consistency in the explicit constructions and postulates. Alternatively, the AGMp system uses the AGM-compliance of LFIs and thus assumes a wider notion of paraconsistency - not necessarily related to the notion of formal (...) consistency. (shrink)

The debate over Plato’s “ so called unwritten doctrines”, which he communicated only to a small circle of trusted disciples, has caused a stir among philosophers in recent decades. Rafael Ferber assumes a differentiated position in this controversy. He is convinced that the unwritten doctrines did exist, but that Plato, for reasons inherent in the process of gaining knowledge, was unable to communicate these doctrines even to his closest disciples. In this book, Ferber outlines the discussion and summarizes the (...) standpoints of greatest interest. Ever since Aristotle, we have known that Plato did not put his most important teachings into writing, but instead communicated them only orally to the inner circle of his disciples. While the extant dialogues merely pass down Plato’s “exoteric” doctrines, his most important “esoteric” insights were not meant for the general public. In the meantime, the contents and the significance of Plato’s “unwritten doctrines” have become the subject of debate in philosophical circles. Fifteen years ago, at the height of the controversy over the “unwritten doctrines”, Rafael Ferber entered the fray with a small book. He proposed that Plato was also unable to communicate the “unwritten doctrines” because the highest principles (i.e. the subject of the unwritten doctrines) cannot be known through logical operations due to an epistemological paradox. Ferber’s differentiated position met with great respect and acceptance, although in individual cases it was also rejected. Ferber’s new book again presents the text of 1991, but significantly expands on it through new perspectives and an outline of the discussion it triggered. In this book, the reader learns what is meant by Plato’s unwritten doctrines and what the controversy is all about. (shrink)

This article asks the question “Why did Plato not write the ‘unwritten doctrine’?” and answers it by citing a combination of two obstacles. The first derives from the limitations of the episteme available to an embodied soul about the essence of the good. Even if the dialectician has access to some kind of knowledge, the mismatch between the unchanging essence of the good and the precarious logoi which aim to identify it (and allow others some measure of access to it) (...) can never fully be overcome. At best, Socrates (or Plato) can lead souls to an incomplete account of it: It is possible that even the most expert dialectician can only have a claim to knowledge, but no absolute certainty. Another obstacle lies in the audience or readership itself: No shortcut to understanding is possible, and yet a mere written presentation, which is all they have, is just such a shortcut, and so represents an empty promise. As the intuitions about moral phenomenology shows the metaphysical distinction between mind-dependent and mind-independent properties has set the metaethical distinction between normativity and objectivity in ethics. Traditionally, many arguments were built in order to show that moral realists cannot account, in naturalist vocabulary, for the process of determining moral reference due to the desiderative disposition taken to be necessarily part of the meaning of moral terms. This dissertation assess some anti-realists arguments like is-ought thesis, the argument from queerness, the argument (...) from relativity and the open question argument. In what follows I propose the semantics elaborated by Cornell realism in order to address these arguments, especially the open question argument. However, as Moral Twin Earth test shows us the semantic proposed by Boyd is incomplete. Therefore I also evaluate a second attempt taken by Cornell realists such as Brink and Copp, based on Putnan's notion of referential intentions. (shrink)

En la literatura sobre las emociones una de las teorías con mayor fuerza es la llamada “teoría James-Lange”. En esta obra se intenta hacer una crítica a dicha teoría a partir de algunas observaciones de Wittgenstein sobre el uso de conceptos psicológicos, sacando a la luz dos confusiones gramaticales que surgen en ella. Para ello, se construye primero la categoría de “programa de naturalización de las emociones” que recoge las teorías del Descartes, James y Prinz, siguiendo la metodología de Lakatos. (...) Luego, se identifica como problema central el de la naturalización de la intencionalidad. Para luego exponer algunas herramientas de Wittgenstein para estudiar la gramática de la pregunta por el objeto y la intencionalidad las emociones, mostrando que las respuestas del programa de naturalización no son satisfactorias y no respetan las reglas de ciertos usos del lenguaje. This paper deals with the deuteros plous, literally ‘the second voyage’, proverbially ‘the next best way’, discussed in Plato’s Phaedo, the key passage being Phd. 99e4-100a3. I argue that (a) the ‘flight into the logoi’ can have two different interpretations, a standard one and a non-standard one. The issue is whether at 99e-100a Socrates means that both the student of erga and the student of logoi consider images (‘the standard interpretation’), or the student of logoi does not consider images but (...) that “consistency should suffice for truth” (‘the non-standard interpretation’); (b) the non-standard one implies the problem of the hypothesis, a problem analogous to the problem of the elenchus; (c) there is a structural analogy between Descartes’ ontological argument for the existence of God in his 5th Meditation and the final proof for the immortality of the soul in the Phaedo. Este artigo investiga alguns usos da metáfora da linguagem como cálculo em Wittgenstein. A metáfora do cálculo emerge, nos anos 30, numa interlocução com o referencialista, e é ali instrumental na recondução do olhar filosófico para os usos efetivos do simbolismo linguístico. Contudo, foi levada longe demais, ao sugerir uma imagem da linguagem composta apenas de inferências à maneira dos sistemas de regras fechados. Isto embargaria certa expansão pragmática do contexto criterial da análise conceitual. Mas a aplicabilidade do símile do (...) cálculo não é invalidada. A metáfora será reativada em manuscritos posteriores, sempre e quando puder servir aos mesmos propósitos do período intermediário, à medida que o ambiente dialógico convoque novas vozes dogmaticamente referencialistas. Ainda assim, é nos manuscritos intermediários que melhor se esclarece o seu funcionamento. Tal movimento exemplifica, por fim, um método filosófico que não procede por meio da superação de problemas à maneira científica. (shrink)

Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. *Winner of the American Philosophical Association's 2020 Essay Prize in Latin American Thought* This essay offers a novel account of the secularity of Latin American liberation philosophy. It challenges the accepted notion that liberation philosophy applies the methods and approaches of Latin American liberation theology to the philosophical arena, thus putting liberation theology on secular grounds. While this formulation is true insofar as liberation philosophy is not bound by the hermeneutics of any particular religious tradition, this formulation could be misconstrued (...) given that liberation philosophy does not premise such secularization in an undialectical understanding of secularity as secularism that disavows religion. Rather, liberation philosophy’s secularity is dialectical in that it requires constant engagement with re-ligion, not in the hermeneutics of any specific tradition but with “the traditional question of the Absolute.” Due to this often-misunderstood element of liberation philosophy, it has frequently been “ghettoized and relegated to the ‘safe’ area of theological studies,” as Eduardo Mendieta argues. However, I contend that liberation philosophy’s secular grounds offer an original contribution to philosophy as a decolonial and postsecularist liberation philosophy, one that conceives of secularism as an aspect of coloniality to be overcome, an obstacle rather than a benefit for Latin American philosophers seeking to gain a better understanding of our historical conditions. The article first gives an exegesis of the famous passage in the "Republic", 505d11-506a2. Attention is drawn to the fact that the principle that every soul does everything for the Good can be translated in two ways: Every soul does everything for the sake of the Good, or goes to all lengths for the sake of the Good. Depending on the different translations, we have a different picture of the platonic Socrates in the Republic, an intellectualistic Socrates for whom irrational (...) desires do not exist, or a Socrates who also accepts irrational desires. The article favours the first one. Then it attempts to show that we can elucidate some dark points in the Socratic thesis that the Good is what every soul pursues and for which every soul does everything, with the help of Aquinas’s distinction between it actio hominis and actio humana. Finally, the article outlines three substantive answers to the question “What is the Good?” – the henological, the perfectionist and the structuralist. Instead of advancing a new answer, the article suggests an uncontroversial formal starting point for an answer to this question. (shrink)

Despite the fact that Aristotle and Frege/Russell differ in how to understand the ambiguity in the meaning of the word “is”, their theories share a common feature: “is” does not have a normative meaning. This paper, however, (I) shows (a) that there is a normative meaning of “is” (and correspondingly a constative meaning of the word “ought”) and (b) that the ambiguity of “is” is itself ambiguous. Furthermore, it proposes (c) a performative criterion for making a distinction between constative and (...) normative “is”. Thereby, (II) a new interpretation of Kant’s critique of the ontological argument (CPR A 598/B626) makes sense: The difference between being as a real predicate and being as a position depends on the difference between “is” as a descriptive and “is” as a normative predicate. (III) The criterion also makes possible a new answer to Leibniz’s and Schelling’s question, “Why is there something rather than nothing?”: The “is” in “there is something” is normative and the question means “Why shall there be something rather than nothing?”. As “there shall be nothing” is self-refuting, the question evokes an ultimate foundation in a practical sense. (shrink)

The article is the revised version of an inaugural lecture given at the University of Lucerne on 8 November 2001. In part (I), I give an interpretation of the first sentence of the Aristotelian Metaphysics: ‘All men desire by nature to know’. In part (II), I show how, for Aristotle, this desire to know constitutes a continuum from knowledge given by sense perception to knowledge of the first principles. In part (III), I compare this Aristotelian conception to Plato’s more ‘existentialist’ (...) approach which implies the turning of a ‘whole soul’ rather than a continuum. Preferring the latter concep- tion, I conclude with some hints of what I plan to do in the next years and give a short overview of the history of universities in Europe and Switzerland, ending with the University of Lucerne. In the whole Corpus Platonicum, we find in principle only one "direct argument" (Charles Kahn) for the existence of the ideas (Tim.51d3-51e6). The purpose of the article is to analyse this argument and to answer the question of why Plato in the Timaeus again defended the existence of the ideas despite the objections in the Parmenides. He defended it again because the latent presupposition of the apories in the Parmenides, the substantial view of sensibles, is removed through the introduction of (...) space as "substantialized extension". First (I) it is shown that Plato remained in dialogues, like the Sophist and Politicus, faithful to the "theory of ideas" despite his criticism in the Parmenides. The common theme in the trilogy of the Theaetetus, Sophist and Politicus is to refute relativism by showing that any relativism presupposes something absolute that is something like the "theory of ideas". The second part of the paper (II) examines closely the logical structure of the argument for the existence of ideas in the Timaeus (51d3-52a7). The third part (III) shows how this argument can avoid the criticism of ideas in the Parmenides. In the Parmenides, sensibles are treated as substantial entities. But, as the Timaeus shows, sensibles are not substantial entities but merely qualities, namely qualities of space, which is the only substance in the sensible world. The paper proposes (1.) a non-standard interpretation of the proverbial expression “deuteros plous” by giving a fresh look to Phaedo, 99c9-d1. Then (2.) it proceeds to the philosophical problem raised in this passage according to this interpretation, that is, the problem of the “hypothesis” or the “unproved principle”. It indicates finally (3.) the kernel of truth contained in the standard Interpretation and it concludes with some remarks on the “weakness of the logoi”.

"Paraconsistent Belief Revision Based on a Formal Consistency Operator" delves into Belief Revision—a significant area of research in Formal Philosophy that uses logic to model the ways in which human and artificial agents modify their beliefs in response to new information and examines how these changes can be considered rational. -/- Originally authored as a PhD thesis (previously published in Portuguese), this work provides a novel epistemic interpretation of Paraconsistency through Paraconsistent Belief Revision systems. It explores the concept of paraconsistency (...) from the standpoint of epistemic attitudes of acceptance and rejection. -/- This work challenges the traditional notion that accepting a new belief requires retracting its negation from the current epistemic state. The author contends that such reflexive retraction goes against the principle of informational economy, which is a crucial aspect of rationality in the context of belief change. Consequently, the phenomenon of paraconsistency is further examined from this fresh perspective of belief change, shedding light on the complexities of the Logics of Formal Inconsistency (LFIs). This is a report on the II Symposium Platonicum, which took place in Perugia, Italy, September 1-6, 1989, and on the founding of the International Plato Society, which took place in Bevagna, Province of Perugia, Umbria, Italy, September 3, 1989.

This paper intends to show that Friedrich Nietzsche’s approach to morality or ‘immorality’ involves an attempt to see moral beliefs as a product of human psychology, rather than as a set of metaphysical ‘truths’ that are somehow given to, or discoverable by, us. Nietzsche wants to replace the metaphysical (or supernatural) account of morality with a natural one, and his treatment of moral belief-systems, from the perspective of this concern, can be divided into (a) a psychological analysis of the true (...) nature of moral action and agency, and (b) an historical/genealogical tracing of the real origins of moral values. In this paper I am going to focus on the second dimension of Nietzsche’s analysis through references from his polemical texts Beyond Good and Evil, Genealogy of Morals, Gay Science, and Will to Power. I will outline Nietzsche’s historical leitmotif on the morality of ressentiment or slave morality and will show how it figures as a point of departure for his revolutionary transvaluation of values, one that places a new order of morality which is disparagingly called ‘immoralism.’ Next, I will discuss Nietzsche’s treatment of bad conscience and posit that it involves two different stages: one is the present stage of the bad conscience as a feeling of guilt, and the other is an earlier stage. I shall argue that in order for this earlier stage to develop into the level of guilt, he needs another element, namely an indebtedness towards gods, which finds its most striking culmination in the Christian heritage of religious dogmatism. Finally, I will discuss how for Nietzsche Christianity as an ascetic ideal has promoted to preserve a declining life, i.e. a slave morality, for all of humanity. (shrink)

The first part of the paper (p. 10-21) tries to answer the first question of the title and describes a set of seven “knowledge-claims” made by Socrates: 1. There is a distinction between right opinion and knowledge. 2. Virtue is knowledge. 3. Nobody willingly does wrong. 4. To do injustice is the greatest evil for the wrongdoer himself. 5. An even greater evil is if the wrongdoer is not punished. 6. The just person is happy; the unjust person is unhappy. (...) 7. The pleasant is not the good. These claims seem to be the “few” (oliga) (Men. 98 b3) but “very important” (kallista) (Grg. 472 c8) things that Socrates claims to know. The second part (p. 22-39) tries to answer the second question and defends the thesis that the supposed “knowledge” of Socrates is dianoetic, but not noetic. The anthropologist James Frazer investigates the ritual gesture in search of be- liefs about the physical world by the native. Wittgenstein considers this a case of aspect- blindness, one that is disruptive of the conditions for understanding the native’s most triv- ial gestures. Unable to cast his glance from within the native situation, this methodological view from nowhere has an arresting effect on experience – in particular, the experience of speaking. This interruption is to be examined by means of a (...) thought experiment. Then, through the interplay of the concepts of Spirit and Aspect, a philosophical tool is described to assess the problem that can also serve as practical guide back to ordinary experience. The next step is to examine this way out in a particularly sensitive kind of experience of meaning: the aesthetic experience, also seen as a ritual. We conclude by alluding to a pos- sibly mutual illumination between aesthetic experience, translation studies and a Cavellian take on ordinary language. (shrink)

This article explores Axel Honneth’s attempts to reconnect the struggles of workers with the normative content of modernity through Hegel’s intersubjective account of recognition. The importance of Honneth’s writings lies in his attempt to extend Habermas’ account of normative self-constitution to labor via the morally motivated struggles of workers to correct the modern maldistribution of social worth. To this extent, the expansion of ethical life is predicated on the struggles of excluded participants to gain inclusion within the normative content of (...) modernity. From this perspective Habermas’ attempt to legitimate the exclusion of labor (by the system) from the normative content of modernity appears unjust and unjustified. Unfortunately, Honneth shares with Habermas a tendency to locate the economic system beyond the (culturally defined) limits of ethical life. He thereby fails to acknowledge the extent to which workers play a major role in re-moralizing the former via the de-reification of the latter. (shrink)

Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Wittgenstein’s mature philosophy offers a therapeutic way out of some conundrums stemming from taxonomic expectations regarding philosophical description of experience in general. The paper asks if this is also true of the facts of aesthetic experience. This possibility is hinted at by examining an application of the notion of certainty to aesthetic experience. Some traits of possible uses of central concepts of the mature Wittgenstein to a philosophical aesthetics inspired by the “new method” are also canvassed.

Conceptual analysis is one of the notions undergoing dramatic changes during Wittgenstein's intermediate period. There's an aspect of such changes which might prove characteristic of the new directions taken by Wittgenstein's thought after 1929: it is the notion of complete analysis. We believe that Wittgenstein's treatment of this notion is also an interesting indication of new concerns generated by the "new method" itself, in terms of its radical openness to dialogism and its anti-dogmatism. A strange dialectical reversal characterizes the oppositions which psychoanalysis posits against philosophy and neuroscience: what psychoanalysis intervenes with as a unique and missing quality of these subjects, reveals itself upon enquiry as already having been a feature of said subjects. This article first discusses the failed intervention of psychoanalysis within the perceived totalities and absolutes of German idealism. Psychoanalysis, founded on an ontological division and internal inconsistency with a retroactive logic, finds this internal contradiction already reflected within the supposed totalities (...) of Schelling and Hegel. Schelling’s “blind act,” a decision with no prior foundation that grounds an abstract identity-in-itself, appears as the counterpart to what Badiou calls the strictly “analytic act.” Hegel’s Science of Logic, in which the inconclusive interpenetration of being and nothing presupposes its own conclusion in the transitions to essence, and in which an internal incompleteness and contradiction are retroactively constitutive of the concept, similarly nullifies the intervention of psychoanalysis. Finally, precisely such a reversal is presented in neuroscience, where the constitutive contradiction of contingently functional neuronal formations in the adaptive “multiple demand” model of executive functioning repeats the contingent and self-contradicting psychoanalytic subject as being its own deference within linguistic, discursive formations. The paper gives (I) a short introduction to Aristotle’s theory of the soul in distinction to Plato’s and tries again (II) to answer the question of whether the individual or the general active mind of human beings is immortal by interpreting “When separated (χωρισθεìς)” (de An. III, 5, 430a22) as the decisive argument for the latter view. This strategy of limiting the question has the advantage of avoiding the probably undecidable question of whether this active νοῦς is human or divine. (...) The paper closes with an outlook (III) on the Christian belief in the resurrection of body and soul in a spiritual body (σῶμα πνευματικóν) (1 Corinthians: 15, 44) by accentuating the ethical aspect of the belief in individual immortality as a “need of reason” (Vernunftbedürfnis) (Kant, Critique of Practical Reason, A 256–258). A Revisão de Crenças estuda como agentes racionais mudam suas crenças ao receberem novas informações. O sistema AGM, trabalho mais influente desta área apresentado por Alchourrón, Gärdenfos e Makinson, postula critérios de racionalidade para os diferentes tipos de mudança de crenças e oferece construções explícitas para tais - a equivalência entre os postulados e operações é chamado de teroema da representação. Trabalhos recentes mostram como o paradigma AGM pode ser compatível com diferentes lógicas não-clássicas, o que é chamado de AGM-compatibilidade (...) - este é o caso da família de lógicas paraconsistentes que analisamos, as Lógicas da Inconsistência Formal (LFIs, da sigla em inglês). A despeito da AGM-compatibilidade, ao se partir de uma nova lógica sua racionalidade subjacente deve ser entendida e sua linguagem deve ser efetivamente usada. Propomos assim novas construções que de fato capturam a intuição presente na LFIs - é o que chamamos de sistema AGMo. Com isso, possibilitamos a estas lógicas uma nova interpretação, na esteira da epistemologia formal. Em uma abordagem alternativa, ao se partir da AGM-compatibilidade os resultados AGM podem ser diretamente aplicados às LFIs - o que chamamos de sistema AGMp. Em ambas abordagens, provamos os respectivos teoremas da representação sempre que necessário. (shrink)

This is an obituary notice in memoriam Martina Stemich.

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. This is a short overview of Plato’s “greatest thing to be learned” or the “greatest lesson” (megiston mathêma) – the Idea of the Good.

The article examines the Socratic principle that (1) virtue is knowledge and its corollary that (2) nobody errs voluntarily (nemo sua sponte peccat). It tries to show (I) that both principles are paradoxa, i.e. from a phenomenological point of view, they seem to be false; (II) that nevertheless the platonic Socrates accepts both principles as true; and finally (III) that these principles are analytical truths a priori which can only be understood if a person (soul) finds them in him- or (...) herself. In his Vermischte Bemerkungen 43, Wittgenstein notices that he was also influenced by Oswald Spengler. The paper deals with the question of in which way Spengler influenced Wittgenstein’s late works and if it really was influence or only a coincidence of ideas. It is put forward that Spengler’s rather unknown philosophy of language influenced Wittgenstein’s philosophy of language, especially the concepts of family resemblance, antiessentialism, and language-game (Sprachspiel). A picture of the famous Neapolitan gesture of “negation” which motivated Wittgenstein to (...) give up the picture theory of language is also shown with an example taken from Andrea de Jorio, La mimica degli antichi investigala nel gestire napoletano, Napoli 1832. It deals with the question of what a moral judgment is. On the one hand, a satisfactory theory of moral judgments must take into account the descriptive character of moral judgments and the realistic language of morals. On the other hand, it must also meet the non-descriptive character of moral judgments that consists in the recommending or condemning element and in the fact that normative statements are derived from moral judgments. However, cognitivism and emotivism or “normativism” are contradictory theories: If (...) moral judgments are descriptive, it is not possible to deduce norms from them. But if one can deduce norms from moral judgments, they are not descriptive. As a solution to this problem, the paper suggests that moral judgments represent institutional facts; the corresponding theory is moral institutionalism. A moral institutional fact – “an act X is Y”, Y means “morally right” or “morally false” – is a hybrid of descriptive and prescriptive elements: It is stating a fact in descriptive language (“is”) and at the same time, it is short for the prescriptive constitutive rule “X is Y according to the moral rules of the language community C”. Institutional facts contain normative presuppositions without letting them appear in their grammatical form. Institutional facts are now (in relation to the language community C) objective and intersubjective and they can be generalized (cognitive aspect), although they cannot be reduced to brute physical or psychological facts, and it is also possible to deduce norms from them because they are built into them. The meta-ethical concept of moral institutionalism, which is evolved further in the paper, preserves the best intentions of emotivism and cognitivism without leading to contradiction. As a by-product, the article shows exactly the still undetected error in J. R. Searle’s alleged counterexample against the so-called naturalistic fallacy from “is” to “ought”. This lies in the normative “are” of the analytic premise or definition in “2a. All promises are [that is ought to be] acts of placing oneself under (undertaking) an obligation to do the thing promised”. (shrink)

In this dissertation, I address the question of how to construct scientific theories of emotions that are both conceptually sound and empirically fruitful. To do this, I offer an analysis of the main challenges scientific theories of emotions face, and I propose a meta-theoretical framework to construct scientific concepts of emotions as explications of folk emotion concepts. Part I discusses the main challenges theories of emotions in psychology and neuroscience encounter. The first states that a proper scientific theory of emotions (...) must explain all and only the phenomena under the vernacular term ‘emotion’ with a common set of conceptual resources and under an overarching generic concept of emotion. The second demands that each emotion category corresponds to well-coordinated sets of neural, physiological, and behavioral patterns of responses. I argue that none of the best contemporary theories of emotions in psychology and neuroscience overcomes these challenges. As a result, a new theory of emotions is required. In Part II, I develop the meta-theoretical framework to construct a theory of emotions that overcomes the challenges above. First, I propose a pluralistic account of scientific kinds based on different patterns of projection that various disciplines may take to justify inductive inferences. These are essentialist, historical, and social patterns. Each of these patterns provides a framework to construct different types of scientific concepts. I argue that among the frameworks for scientific kinds available, the one that is best suited to explicate emotion concepts is a functional framework. Consequently, I conclude by recommending scientists pursue functionalist theories of emotions over essentialist, historical, or social theories. (shrink)

Plato scholars such as Matthias Baltes (1940-2003) and Luc Brisson have defended the thesis that Plato‘s Idea of the Good is on the one hand beyond being (epekeina tês ousias) in dignity and power, but is nevertheless not transcendent over being. The article gives first (I.), an introduction into the status questionis. Second (II.), it delivers the most important arguments for the thesis of Baltes and Brisson. Third (III.), it gives two counterarguments against the thesis. Fourth (IV), it deals with (...) the translation of L. Brisson "Apollon, quelle merveilleuse emphase" of 509c1-2. By Belief Revision it is understood a system that logically explains the rational process of changing beliefs by taking into account a new piece of information. The most influential approach in this field of study, the AGM system, proposed by Alchourrón, Gärdenfors, and Makinson, postulates rationality criteria for different types of belief change. In this paper I shall assess the relationship between those criteria and argue for an opposition between the principles of Information Economy and Consistency. Furthermore, I shall argue (...) that Paraconsistent Belief Revision manages to minimise this friction in the best possible way. (shrink)

This article considers the historical tension in conceptualising Marx's materialism (dialectical and historical) as either a break from, or a fidelity to, Hegelian dialectics, and the methods by which this tension is itself subsumed under an insistence on vindicating the radical irreducibility of Marxist thought. Ultimately, however, it is argued that the question of whether Marx should or should not be framed alongside Hegel is the wrong question. It is not a question of 'Marx by himself' or 'Marx and... [Hegel]', (...) but rather of 'Marx without himself': as with any radical event in the history of ideas, it is a benefit to Marx's innovativeness that he can be retrospectively articulated according to historical traditions whilst simultaneously breaking from them. -/- . The first chapter, "Der Hintergrund von Gadamers 'Phänomenologischen Interpretationen' in Sein und Zeit" traces the origins of Gadamer’s interpretation of the Philebus in Sein und Zeit. Especially important is that Dasein is, thanks to speech , already outside of itself in the world. The second chapter "Gadamers Dialektische Ethik" gives a short summary of the main points of Gadamer's interpretation of the Philebus. The third chapter "Davidsons reinterpretation of von Gadamer's Dialektischer Ethik" 222-231), points especially to the fact that Davidson (...) sees the "Socrates post Vlastos" in the interpretation of Gadamer at work: Because every man is already in possession of some basic truths, coherence is enough to lead to substantive truths. Davidson concludes that only in “interpersonal communication” "can be thought, a grasping of the fact of an objective, that is, a shared world". Thus, Davidson sees in Gadamer's interpretation of the Philebus his own theory of triangulation anticipated. (shrink)

Revision operation is the consistent expansion of a theory by a new belief-representing sentence. We consider that in a paraconsistent setting this desideratum can be accomplished in at least three distinct ways: the output of a revision operation should be either non-trivial or non-contradictory (in general or relative to the new belief). In this paper those distinctions will be explored in the constructive level by showing how the remainder sets could be refined, capturing the key concepts of paraconsistency in a (...) dynamical scenario. These are preliminaries results of a wider project on Paraconsistent Belief Change conduced by the authors. (shrink)
